Abstrak

The application of law to perpetrators of crimes that cause death in an act of crime so that the judge's considerations in deciding death penalty cases are seen from the perspective of positive law or from a human side where the judge must also examine and see the law that develops in society so that it is known how is the sentence imposed in the decision by the judge who decided on the death penalty so that in imposing a sentence the judge is lighter to sentence the perpetrator of the murder first the judge considers aggravating and mitigating matters for the perpetrator when it is related to the facts that have been revealed in trials so that in applying an article or law the judge pays more attention to the consequences of the actions of the perpetrators of criminal acts in order to create the fairest possible decision both for the defendant as well as for the victim;
