LEGAL ANALYSIS OF ILLEGAL LOGGING IN INDONESIA AND ITS SOLUTIONS

Abstract

Environmental management must provide economic, social and cultural benefits and needs to be carried out based on the principles of precaution, environmental democracy, decentralization, as well as recognition and respect for local wisdom and environmental wisdom, so that the Indonesian environment must be protected and managed well based on the principles state responsibility, the principle of sustainability and the principle of justice. Illegal Logging should be an important concern for all parties to find solutions to this illegal activity. The impact on environmental sustainability is due to illegal logging of forests carried out by people who only seek commercial profit without caring about the consequences of their actions. The problem of illegal logging in Indonesia is not a problem that is too early for us to know about, the problem of illegal logging has often occurred in Indonesia. The impact of illegal logging must be a concern for all parties, not just the authorities or government. Because the impact of illegal logging is often felt by the community. This research uses normative legal research. Normative Legal Research is legal research carried out by examining library materials or secondary data. Discussion Results 1. Legal Analysis of Illegal Logging: Illegal Logging has been regulated in Law Number 18 of 2013 concerning Prevention and Eradication of Forest Destruction. Illegal logging or often called Illegal Logging is an act that violates the law for which strict sanctions have been regulated in the Law. The criminal threat is 1 to 15 years and a fine ranging from IDR 10,000,000 (ten million rupiah) to IDR. 15,000,000,000,- (fifteen billion rupiah). This law was deliberately created as a regulation for preventing and eradicating forest destruction. So that in the future the prevention and eradication of illegal logging can be carried out properly in accordance with what has been regulated in the law. 2. Impact on illegal logging and solutions: The main impacts are deforestation, loss of biodiversity and global warming. Other impacts of illegal logging are as follows: 1. Soil fertility will decrease; 2. Springs decrease; 3. Cause flooding; 4. Extinction of forest plant and animal species. The solution: 1. Reforestation or replanting of deforested forests. Intensive forest planting is the best choice because it can be predicted so that wood needs can be calculated without destroying good natural forest habitat; Applying a selective logging system in cutting down trees
