LEGAL CONSEQUENCES OF A LAWSUIT WHERE ONE OF THE PARTIES DIES
Abstract
Based on the description of the previous chapters, the following conclusions can be drawn: The results of the research show that the position of a case where one of the parties dies, then one or all of the heirs of the deceased can continue to investigate the case further by first taking care of determining the heirs or certificate of heirship at the District Court and then submit a request to a panel of judges to examine and try the case, then if none or all of the heirs of the deceased can continue the case then the lawsuit must automatically be declared invalid. As for the legal mechanism for interested parties entering a lawsuit where one of the parties dies while the examination is taking place, one or all of the heirs of the deceased must first arrange for the determination of heirs or a certificate of heirship at the District Court, then submit a written request to the Court. State regarding his wishes to continue the matter
