LEGAL MECHANISM FOR PREVENTION AND CANCELLATION OF MARRIAGE BASED ON COMPILATION OF ISLAMIC LAW IN INDONESIA

Abstract

This study aims to find out about the legal mechanism for preventing and annulling marriages, and what is the position of children in preventing and annulling marriages. The method used in writing this journal is a qualitative method with data collection techniques is library research which is collected and analyzed using descriptive techniques. Based on the results of the study, it shows that the legal provisions for the prevention and annulment of marriage mechanisms can be carried out by submitting a request for prevention or annulment of marriage to the Court / Religious Court which governs the place where the husband or wife lives or where the marriage takes place. The procedure for submitting an application for annulment of marriage is carried out in accordance with the procedure for filing a divorce suit. Based on the results of the research, it should be suggested that the government needs to pay attention to the weaknesses and deficiencies in the regulations regarding the prevention and annulment of marriages
